JOB SUMMARY
Under the supervision of a higher classified employee, performs complex administrative and legal work, drafts motions and proposed orders, conducts custody, parenting time, and child support investigations and issues recommendations to the court. Appears in court on behalf of FOC as needed for motions or hearings. Appears in court on behalf of FOC on non-payment of support and takes enforcement action on child support, medical support/reimbursement, parenting time, and intergovernmental issues.
EXAMPLES OF DUTIES
Essential Duties:

  • Conducts investigations on custody, parenting time, child support, spousal support, domicile, school placement, or other issues referred by the court, and issues a report and recommendation.
  • Interviews involved parties, including children, to obtain case information and develop an accurate account of the case; examines various records for supportive data.
  • Conducts mediations and/or joint meetings on custody, parenting time, child support, spousal support, domicile, school placement, or other issues as referred by the court or requested by parties within Michigan law.
  • Monitors relevant objection period for issued recommendations and sends orders to the court upon completion of the objection period or objection hearing.
  • Communicates with parties, attorneys, and court staff regarding scheduling for FOC hearings and appointments, and objection filings or objection periods pertaining to FOC recommendations.
  • Reviews case and/or reports generated by FOC and/or OCS systems to determine eligibility for administrative child support reviews in compliance with Michigan law and office policy.
  • Reviews and calculates child support.
  • Reviews and approves Judgments of Divorce and other domestic orders submitted by outside attorneys and pro per litigants.
  • Meet with litigants to gather case information, answer questions, respond to complaints, or resolve problems. Meetings may be held in the FOC office, courtroom, jail, or other designated locations.
  • Completes various special projects, which require professional legal skills, as requested by a Trial Court Judge or the Friend of the Court.
  • Conducts show cause hearings for non-payment of support, parenting time, and medical support.
  • Prepares and appears in court on motions on behalf of Friend of the Court as needed.
  • Prepares orders as requested by a Trial Court Judge or the Friend of the Court.
  • Appears in court and provides recommendations on various topics.
  • Review files to determine proper service prior to issuing a bench warrant.
  • Reviews objections and other issues related to bankruptcy, credit reporting, passports, and bank liens to determine the appropriate enforcement action.
  • Processes parenting time enforcement requests and takes appropriate action pursuant to statute.
  • Conducts joint meetings regarding child support reviews and/or enforcement matters such as parenting time denials, bond forfeiture, arrears payment plans, medical reimbursements, and other miscellaneous enforcement matters.
  • Works on reports to improve FOC performance measures and case accuracy assigned by management.
  • Provides backup assistance of a legal nature to clerical and professional staff.
  • Performs other related duties as assigned.

EMPLOYMENT QUALIFICATIONS
Knowledge, Skills, and Abilities:

  • Knowledge of modern principles and practice of law and of local, State and Federal laws.
  • Knowledge of functions and procedures of the Friend of the Court.
  • Knowledge and skill analyzing and researching statutes, case law and interpreting legal documents.
  • Knowledge of applicable federal, state, and local regulations.
  • Proficient skills using Microsoft Office programs including, but not limited to: Word, Excel, and Outlook required.
  • Skills in exercising sound judgment and decision making in accordance with policies and procedures; ability to research and problem solve independently; knowledge of County operations and functions; ability to prioritize and time manage; handle stressful situations, provide effective and friendly customer service; support the Court's mission and values; ability to think critically where necessary.
  • Ability to use discretion and maintain sensitive and confidential information.
  • Ability to work with adverse parties to reach productive resolutions to issues.
  • Ability to work independently or part of a team; ability to interact appropriately with others such as Court and County officials, employees, vendors, and the public.
  • Communicating effectively with litigants, including children (interviewing and writing skills).
  • Performs effectively under stress, attaining precise set limits, tolerances, and standards.
  • Position may require use of personal vehicle.
LICENSES/CERTIFICATIONS
Licensed to practice law in the State of Michigan.
Possession of a valid driver's license.
Certified Domestic Relations Mediation Training Certificate within one year of hire.
BACKGROUND CHECK
Pursuant to MCL 15.651 - 15.654, Public Employee Fingerprint-Based Criminal History Check Act, all IV-D staff will be subjected to a fingerprint-based background investigation.
Additional satisfactory background check if requested by a partnering agency.
PHYSICAL DEMANDS
Duties require sufficient mobility to work in a normal office setting and use standard office equipment including a computer, vision to read printed materials and a computer screen, and hearing and speech sufficient to communicate in person or over the telephone. Duties may require an employee to exert up to 25 pounds of force occasionally, or up to 10 pounds of force frequently, or a negligible amount of force constantly to move objects.

EDUCATION
Possession of a Juris Doctor (JD) degree and a member in good standing of the State Bar of Michigan.
EXPERIENCE
One year of family law experience is preferred, or equivalent combination of education and/or experience.
